On returning to Scotland - after hiding out in California for a long time - I come across the EU regulations concerning the “Cookie Law”. Not being a lawyer, I decide to ignore it since I do not use any tracking of individual users preferences or other info. Those of you who use scripts which invade your visitors privacy - such as Google Analytics or StatCounter - will need to take some action. The bare minimum for compliance is to exhibit a warning on page load which can be dismissed if the visitor is happy with some website owner prying into their preferences. With this type of cookie statement, the visitor has no option to opt out and their only recourse is to leave the site which isn’t really what we want them to do! A link to a cookie policy statement may reassure them that you are not a front for the CIA but, unless this is compiled accurately, you leave yourself open to prosecution. For example, if you are using Google Analytics, you need to list all the data which is being collected and I doubt if the average webmaster knows what this is. If you want them to browse the site without collecting their data, a “decline” button can be added to the cookie banner which disables the analytics and any other data collecting scripts. This means using a cookie script that allows for disabling the analytics and requires the user to wrap these scripts in an “if” statement. I notice that, in another topic, there is some discussion about using the “Cookie Consent” plugin. This appears to work OK as long as you link to your consent policy and employ the services of a lawyer with analytics code knowledge to write it! The downsides are lack of easy styling options and no option to dismiss cookies to prevent those who do not agree from leaving the site. There are other options which provide a better solution. Perhaps someone will create a widget for it although I do feel that this should be integrated within EverWeb to help stop their European customers from being prosecuted. From my interpretation of the law, the cookie policy extends to any website which makes itself available to visitors in European Union Countries. In my Country (Italy) where the laws are particularly confused and confusing, it is even more difficult to understand and to reach what requested by the EU laws. I guess It can help this Google feature I have found on the web opt-out analytics. That feature can be a button inside the banner or on the "privacy policy" page, which is everytime compulsory, even in case of no cookies. The "privacy policy" page should contain, as you wrote, all the kind of cookies used by the website, a complete explanation of the meaning and how the cookies work; that is at least 2 pages... Anyway I agree with you Roddy, a new widget will surely help all those are not exactly technically prepared. FYI the solution of this post cookie consent works fine but it is visible only when online. I have also found this js http://ec.europa.eu/ipg/basics/legal/cookies/index_en.htm#section_5 supplied by the European Commission; not yet tested... Last edit 10 years ago |

The stuff on THIS PAGE is very informative but probably more than most users need to know. For most webmasters, the simple solution is not to use Google or any other analytics, remove social media widgets/plugins and use Vimeo instead of YouTube. I find that the analytics provided by my hosting company are sufficient for my needs.
